San Joaquin Valley Unified Air Pollution Control District (Governing Board)

The Unified District shall have all powers and perform all duties applicable to air pollution control districts allowed by state and federal law, including, but not limited to, the following: Develop and adopt uniform basin wide rules and regulations to achieve and maintain state and federal ambient air quality standards within the Unified District. Adopt measures to control all sources of air pollution as allowed by law. This shall include the development and adoption of all air quality plans required by state and federal law for the San Joaquin Valley. Enforce all applicable provisions of state and federal law dealing with air pollution within the Unified District?s boundaries. This shall include uniform enforcement procedures and uniform fines and settlement fines. Develop regional attainment plans, common planning criteria, and uniform permitting and enforcement procedures. This shall include responsibility for oversight and supervision over all permit systems for Authorities to construct and permits to operate within the Unified District?s boundaries. Employ agents, consultants, advisories, independent contractors, and employees, including but not limited to an Air Pollution Officer as the Chief Administrator of the Unified District, and contract for professional services. The Air Pollution Control Officer and other persons engaged shall receive compensation as may be determined and approved by the Unified District. Make and enter into any contracts. Acquire, hold, and convey real and personal property. Incur debts, obligations, and liabilities. Accept contributions, grants or loans from any state, public or private agency or individual, of the United States or any department, instrumentality, or agency thereof, for the purpose of financing its activities. Invest money that is not needed for immediate necessities, as the Unified District Board determines advisable, in the same manner and upon the same conditions as other local entities in accordance with Section 53601 of the Government Code. Reimburse Unified District Board members the actual amounts of their reasonable and necessary expenses incurred in attending meetings of the Unified District, or any committee of the Unified District, and in performing the duties their offices, as allowed by law. Sue and be sued. Do all other acts reasonable and necessary to carry out the purpose of this agreement, including public education on air quality issues. Monitor, review, and participate in all environmental processes for projects proposed in the San Joaquin Valley air basin and provide appropriate comments and take necessary actions as allowed by law. Adopt regulations to reduce or mitigate emissions from indirect and are-wide sources of air pollution. Adopt and implement regulations to encourage or require the use of ride-sharing, van pooling, flexible work hours, or other measures to reduce the number of length of motor vehicle trips within the San Joaquin Valley as provided by law. Adopt a schedule of uniform fees provided by law. Adopt rules and regulations and do such acts as may be necessary or proper to execute the powers and duties granted, and imposed upon, district as provided by law.
